This publication covers important issues of establishment, current state and further development of human rights protection in administrative justice of Ukraine, with due consideration to the requirements of the European Convention on Human Rights and its Protocols, the case-law of the European Court of Human Rights and international experience. The results of the corresponding research are directed at uniform application of law by the courts in the sphere of public law, strengthening of the rule of law and fair justice. The publication was prepared for a series of trainings for Ukrainian judges of courts of common jurisdiction on application of the case-law of the European Court of Human Rights (ECtHR), within the project "Safeguarding Human Rights through Courts" implemented by the OSCE Project Co-ordinator in Ukraine with the financial support of the Government of Canada. This edition presents the provisions of the European Convention on Human Rights (Convention) that are of utmost relevance in administrative proceedings. The provisions are disclosed through ECtHR judgements that interpret the Convention principles on the right to a fair trial (Article 6), protection of property (Article 1 of the First Protocol), the right to respect for private and family life (Article 8), freedom of expression (Article 10), freedom of assembly and association (Article 11). It analyzes practices and concerns related to the respect for citizens’ rights during their recruitment into the armed forces, and the rights and freedoms of military personnel as they conduct military service.
