The paper explores legislative amendments in the area of criminalization during the period of effect of 2001 Criminal Code of Ukraine. Special attention is paid to the tendencies of criminalization of the socially dangerous acts, social context in which they happened and the issues that arose as a result of vibrant law-making activity in the field of criminal law.
The relevant legal positions of the Constitutional Court of Ukraine have been studied and conclusions on their consideration in further legislative work developed. The volume demonstrates the urgent need to develop practical methods for promotion of the theory of criminalization of socially dangerous acts through the example of responding to the challenges posed by the COVID-19 pandemic. It is proposed to significantly reduce the text of criminal law as a form of criminalization..
The publication is designed for legislators, judges, scholars, legal practitioners and all who are interested in the problems of criminal, constitutional law and human rights. Available in Ukrainian language.
