Kosovo elections: Right to appeal during the election process

PRISTINA, 6 August 2001 (OSCE) - People in Kosovo who believe their rights regarding the electoral process have been violated have a right to turn to the Election Complaints and Appeals Commission (ECAC).
The Election Complaints and Appeals Commission, established by the Central Election Commission (CEC), is composed of one international chief commissioner and between three and five deputy commissioners from Kosovo. The ECAC is supported by staff consisting of international and national legal advisors and international investigators.
The Commission can adjudicate all complaints and appeals regarding the electoral process of the Kosovo Assembly elections.
If the relevant rules are not being applied properly, people can lodge an appeal with the ECAC. For instance, if a person appealed about the registration process, the ECAC may decide that a person's name must be included on the Voter's List.
Anyone who claims that his or her rights concerning the electoral process have been violated may file a complaint with the ECAC. Like last year, the ECAC will adjudicate violations of the Code of Conduct for political entities and their candidates and supporters. Those violating the code will face sanctions, which can vary from ordering remedial action or imposing a fine to - after approval of the chairman of the CEC - barring persons or entities from taking part in the elections.
The OSCE's regular election briefing this week looks at the role of the Election Complaints and Appeals Commission. The Chief Commissioner, Adriann Stoop, will be on hand to answer any questions.
