Decisions on breaches of electoral code of conduct in Kosovo

PRISTINA, 6 October 2000 - The Election Complaints and Appeals sub-Commission (ECAC) took several decisions and handed out its judgements to political entities for breaches of the Electoral Code of Conduct at a session on 5 October 2000. The details of each decision are attached.
ECAC Case No. ME 2000/024 Defacing Public Areas
On 4 September 2000 four juveniles were found by UN Police defacing public buildings with graffiti of the Democratic Party of Kosovo (PDK), on the order of the PDK, in the town of Kaçanik/Kacanik. The ECAC found the PDK Kaçanik/Kacanik to have violated Electoral Rule 2000/1 and ordered PDK Kaçanik/Kacanik to assist in the clean-up of the graffiti from public areas.
ECAC Case No. ME 2000/039 Public Display of Weapons
The Democratic Party of Kosovo (PDK) held a rally in Skenderaj/Srbica on 25 September 2000. During the rally it was observed that PDK supporters discharged handguns in celebratory fire. Although a PDK organizer warned the crowd to cease, the ECAC noted that the PDK had been previously sanctioned for a similar incident. Therefore, the ECAC decided to fine the PDK 1,000 DEM and reserved the right to recommend the removal of a candidate if the fine was not paid.
ECAC Case No. ME 2000/051 Defacing Public Buildings
During the night of 14-15 September 2000, various building and structures in downtown Obiliq/Obilic were defaced with graffiti of the Democratic League of Kosovo (LDK). The Munucipal Administrator requested that the LDK to clean-up the graffiti, but the only change was a further covering the graffiti. The ECAC found the LDK Obiliq/Obilic in violation of Electoral Rule 2000/1 and fined the LDK branch 2,500 DEM. The fine is to be paid into the municipal budget of Obiliq/Obilic to support clean-up of the graffiti. The ECAC also reserved the right to recommend the removal of a candidate if the fine was not paid.
ECAC Case No. ME 2000/070A Notification of Political Events [AAK]
The Alliance for the Future of Kosovo (AAK) has been found by the ECAC to have violated on seven occasions Electoral Rule 2000/1 on the lack of proper notification of meetings to the International Civilian Police. The ECAC decided to fine the AAK a total of 2,000 DEM and reserved the right to recommend the removal of a candidate if the fine was not paid.

The Democratic Party of Kosovo (PDK) has been found by the ECAC to have violated on three occasions Electoral Rule 2000/1 on the lack of proper notification of meetings to the International Civilian Police. The ECAC decided to fine the PDK a total of 750 DEM and reserved the right to recommend the removal of a candidate if the fine was not paid.

The Democratic League of Kosovo (LDK) has been found by the ECAC to have violated on seven occasions Electoral Rule 2000/1 on the lack of proper notification of meetings to the International Civilian Police. The Democratic Party of Albanian Ashkali of Kosovo (PDASHK) has been found by the ECAC to have violated on one occasion Electoral Rule 2000/1 on the lack of proper notification of meetings to the International Civilian Police. The ECAC decided to warn the PDASHK and reserved the right to issue sanctions if the violation was repeated.
ECAC Case No. ME 2000/077 Removal of PDK Posters
The Democratic party of Kosovo (PDK) filed a complaint with the ECAC alleging that PDK posters in Lipjan/Lipljan were torn down by KFOR. The ECAC dismissed this complaint as the PDK was in violation of the Electoral Rules for affixing posters to a public building.
