Kosovo Media Appeals Board decides on Dita appeal against Temporary Media Commissioner decision

PRISTINA, 18 September - On 16 September 2000, the Kosovo Media Appeals Board gave its decision in the appeal by Mr. Belul Beqaj and the newspaper Dita against a decision of the Temporary Media Commissioner to impose a sanction of DEM 25,000.
The Board, which is competent to uphold, modify or rescind decisions of the Temporary Media Commissioner, found that while there had been a publication contrary to UNMIK Regulation 2000/37 (publication of the personal details of individuals in circumstances creating a risk to life or security), the Temporary Media Commissioner s determination and decision to impose the sanction had not satisfied the procedural guarantees required by internationally recognized human rights and the applicable law in Kosovo.
A majority of the Board ordered that the matter be referred back to the Temporary Media Commissioner to redetermine according to law. One member considered that the procedural errors, though serious, would still allow the Board to exercise its power to modify the original decision, and recommended accordingly.
